These Terms of Service ("Terms") govern your access to and use of HarperFlow, including harperflow.io, the HarperFlow application, free GEO audits, content generation, publishing workflows, reports, integrations, and related services (collectively, the "Services").
The Services are provided by Better Brain Lab LLC, a Wyoming limited liability company doing business as HarperFlow ("HarperFlow," "we," "us," or "our").
By creating an account, connecting a website, requesting a free GEO audit, subscribing to a plan, clicking to accept these Terms, or using the Services, you agree to these Terms. If you use the Services for a company, client, agency, or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
If you do not agree to these Terms, do not use the Services.
HarperFlow provides a GEO/AEO publishing pipeline for Webflow websites and related platforms. The Services may help discover content opportunities, research topics, generate and structure articles, cite sources, create metadata, map content into CMS fields, schedule publishing, send publishing digests, and maintain content workflows.
HarperFlow is not merely a text prompt tool. It is a software, automation, AI, research, and publishing workflow service. You are paying for access to the platform, systems, pipelines, automations, integrations, operational workflows, and related Services, not for exclusive ownership of HarperFlow's technology or methods.
You must be at least 18 years old to use the Services.
You agree to provide accurate account, billing, business, and website information and to keep that information current. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.
You may not share account access in a way that avoids fees, compromises security, violates these Terms, or causes operational risk to HarperFlow or third-party platforms.
You are responsible for:
HarperFlow may support regulated, sensitive, or high-risk businesses within reason. If your business operates in a high-risk or regulated area, including medical, legal, financial, insurance, adult, gambling, political, supplements, alcohol, weapons, controlled goods, or other sensitive categories, you must contact us before using the Services for that business.
We may require additional onboarding, safeguards, compliance review, disclaimers, approval workflows, industry-specific source handling, or written terms. We may refuse, delay, suspend, or condition service where we believe additional safeguards are required.
HarperFlow may offer a 7-day free trial that includes up to 3 free articles during the trial period. Trial terms may vary by offer, plan, customer type, or promotional campaign.
Free trials, audits, reports, and lead magnets are provided for evaluation and informational purposes. We may modify, limit, or discontinue free offers at any time.
Unless otherwise stated, unused trial articles, audit credits, or promotional benefits expire at the end of the applicable trial or promotional period.
Paid plans are billed on a subscription basis. The plan you choose determines your monthly article volume, publishing velocity, and any plan-specific limits.
Unless expressly stated otherwise, article credits and article volume expire at the end of each billing period and do not roll over.
You authorize HarperFlow and our payment processor, Stripe, to charge applicable subscription fees, taxes, and other charges to your payment method.
You are responsible for maintaining a valid payment method. If payment fails, we may provide a 3-day grace period. After that, we may suspend, limit, or terminate access, publishing, generation, integrations, or other Services.
You may cancel your subscription at any time. Cancellation stops automatic renewal but does not necessarily delete your account or data. Unless otherwise stated, your subscription remains active until the end of the current billing period.
Upgrades and downgrades may be prorated. Downgrades may reduce article volume, publishing privileges, features, support levels, or other plan benefits.
Refunds are discretionary unless required by law or expressly stated in writing by HarperFlow. We may provide refunds, credits, or accommodations at our sole discretion.
If HarperFlow suspends or terminates your account for a platform-side or business-side reason unrelated to your breach, non-payment, fraud, misuse, unlawful activity, or violation of these Terms, we may provide a prorated refund for the unused portion of the then-current billing period.
We may change pricing, plan features, limits, article volumes, or billing terms at any time.
For existing customers on old pricing plans, HarperFlow will provide a 3-month transition window after announcing a price increase during which affected customers may remain on their old pricing, unless the change is required by law, third-party cost changes, abuse, plan migration, or other urgent business or technical reasons.
We may provide notice of pricing changes by email, in-app notice, website notice, invoice notice, or another reasonable method.
The Services depend on third-party platforms, infrastructure, vendors, and APIs, including Webflow, Stripe, Supabase, Claude/Anthropic, Google Cloud, Cloudflare, n8n, Postal, Hostinger, Google Analytics, and others.
You acknowledge that third-party services may be unavailable, delayed, changed, suspended, rate-limited, deprecated, or interrupted. HarperFlow is not responsible for failures, delays, losses, or damages caused by third-party services, platform changes, API outages, rate limits, authentication failures, moderation decisions, infrastructure disruptions, or vendor issues.
Because HarperFlow generates and schedules content in batches, temporary disruptions may delay research, generation, publishing, digest delivery, or CMS updates. We will use commercially reasonable efforts to resume normal operations, but we do not guarantee uninterrupted service.
HarperFlow may provide a Monday digest or similar notification showing articles scheduled for the applicable publishing period. The digest is designed to make your workflow easier and keep you informed about scheduled publishing.
You are responsible for reviewing notices, digests, drafts, previews, and published content according to your business needs and legal obligations. Failure to review a digest, email, dashboard, draft, or notice does not make HarperFlow responsible for business, legal, reputational, traffic, ranking, or content consequences.
HarperFlow and its licensors own all rights, title, and interest in and to the Services, platform, software, systems, workflows, automations, prompts, prompt chains, research methods, scoring systems, quality systems, article formats, templates, CMS mapping logic, source-to-snippet systems, internal tools, reports, dashboards, visual designs, documentation, trademarks, branding, know-how, and related technology ("HarperFlow Technology").
You do not receive any ownership interest in HarperFlow Technology.
As between you and HarperFlow, you retain ownership of information, brand assets, business information, website content, customer-provided text, images, logos, trademarks, and other materials you provide to HarperFlow ("Customer Materials"), subject to the licenses granted in these Terms.
You grant HarperFlow a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, copy, process, analyze, transform, display, publish, transmit, modify, create derivative works from, and otherwise use Customer Materials as necessary or useful to provide, operate, improve, secure, market, and support the Services.
The Services may generate articles, summaries, metadata, citations, FAQs, images, callouts, outlines, recommendations, reports, audits, and other outputs ("Generated Content").
Subject to your payment of applicable fees and compliance with these Terms, HarperFlow grants you a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, distribute, and modify Generated Content on websites and channels you own or control for your own business purposes.
HarperFlow will not knowingly reuse the same customer-specific Generated Content as a published article for another customer. However, HarperFlow may retain, analyze, reference, display, and use Generated Content for product improvement, quality control, support, research, benchmarking, internal operations, legal compliance, marketing examples, portfolio materials, case studies, and demonstrations, unless you opt out of marketing use by contacting [email protected].
HarperFlow retains all rights in HarperFlow Technology, including any underlying methods, formats, structures, templates, workflows, prompts, scoring systems, research processes, and automations used to create Generated Content.
You acknowledge that laws governing AI-generated and AI-assisted content are evolving. HarperFlow does not represent or warrant that Generated Content is copyrightable, exclusively owned by you, eligible for copyright registration, non-infringing in every context, or free from third-party claims.
To the maximum extent permitted by law, you are responsible for determining whether Generated Content is appropriate for your intended use and for obtaining legal advice where needed.
Unless you opt out by contacting [email protected], you grant HarperFlow permission to use your name, company name, logo, public website, public screenshots, public published articles, public case examples, and related public-facing materials to identify you as a customer and market HarperFlow.
We will not intentionally disclose confidential non-public Customer Materials in marketing without permission.
HarperFlow may collect, analyze, and use Customer Materials, Generated Content, operational data, usage data, performance signals, audit scores, article metadata, publication history, and workflow data to operate, maintain, secure, troubleshoot, evaluate, develop, and improve the Services.
We may create and use aggregated, anonymized, or de-identified data for any lawful business purpose, including analytics, benchmarking, research, reports, product development, marketing, and industry insights.
You may not use the Services to:
Although HarperFlow generates content through its own systems, you remain responsible for the business context, website, products, claims, industry, compliance obligations, and final use of the content.
We may suspend, limit, throttle, delay, refuse, or terminate access to any account, website, integration, feature, article generation, publishing workflow, or Service at any time, with or without notice, and without being required to provide a reason, to the maximum extent permitted by law.
Examples of reasons for suspension or termination may include:
If suspension or termination is caused by your breach, misuse, non-payment, fraud, legal risk, platform misuse, or violation of these Terms, you may not be entitled to a refund.
If suspension or termination is caused by a HarperFlow business decision or platform-side issue not caused by your breach, misuse, non-payment, fraud, or legal risk, HarperFlow may provide a prorated refund for the unused portion of your current billing period.
We may modify, add, remove, suspend, discontinue, replace, throttle, or limit any feature, integration, workflow, plan, article format, output type, audit, report, or Service at any time.
We do not guarantee that the Services will be uninterrupted, error-free, secure, timely, compatible with every website, compatible with every Webflow configuration, or available at all times.
HarperFlow does not guarantee search rankings, AI citations, traffic, impressions, clicks, customers, leads, revenue, conversions, indexing, backlinks, domain authority, AI engine visibility, Google visibility, ChatGPT visibility, Claude visibility, or any specific business outcome.
Search engines, AI engines, answer engines, social platforms, third-party websites, customers, and ranking systems are outside HarperFlow's control. You use the Services with the understanding that content performance can vary.
The Services and all Generated Content are provided "as is" and "as available."
To the maximum extent permitted by law, HarperFlow disclaims all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, security, and course of dealing.
HarperFlow does not warrant that Generated Content will be accurate, complete, original, non-infringing, lawful for your industry, suitable for regulated use, free from errors, accepted by Webflow or other platforms, indexed by search engines, cited by AI systems, or appropriate for your business without review.
To the maximum extent permitted by law, HarperFlow and its owners, officers, employees, contractors, agents, affiliates, licensors, vendors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost traffic, lost rankings, lost AI citations, lost leads, business interruption, reputational harm, data loss, content loss, website issues, platform suspension, or cost of substitute services.
To the maximum extent permitted by law, HarperFlow's total aggregate liability for all claims arising out of or relating to the Services or these Terms will be limited to the greater of: (a) the amount you paid HarperFlow for the Services in the three months before the event giving rise to the claim; or (b) USD $100.
Some laws may not allow certain limitations of liability. In those cases, HarperFlow's liability will be limited to the smallest amount permitted by applicable law.
You agree to defend, indemnify, and hold harmless HarperFlow and its owners, officers, employees, contractors, agents, affiliates, licensors, vendors, and service providers from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
HarperFlow may control the defense of any matter subject to indemnification, and you agree to cooperate with us.

We may remove or disable access to content, notify affected users, and terminate repeat infringers where appropriate.
Our Privacy Policy explains how we collect, use, share, and protect personal information.
For Agency and Enterprise plans, HarperFlow may provide or enter into a Data Processing Addendum where appropriate. If GDPR, UK GDPR, or similar laws apply and HarperFlow processes personal data on your behalf as a processor, the applicable DPA will govern that processing to the extent required by law.
We may update these Terms from time to time. Unless a longer period is required by law, we may provide 7 days' notice of material changes by email, in-app notice, website notice, or another reasonable method.
Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using the Services and cancel your subscription.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
Please read this section carefully. It affects your legal rights.
To the maximum extent permitted by law, you and HarperFlow agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your account, billing, Generated Content, or the relationship between you and HarperFlow will be resolved by binding individual arbitration, rather than in court.
The arbitration will be conducted remotely by video, telephone, or written submissions, unless the arbitrator determines otherwise. The arbitration will be administered by the American Arbitration Association ("AAA") under its applicable commercial arbitration rules, unless the parties agree to another administrator.
You and HarperFlow waive the right to a jury trial.
You and HarperFlow agree that disputes may be brought only on an individual basis and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative action.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court for intellectual property misuse, unauthorized access, security incidents, confidentiality breaches, or misuse of HarperFlow Technology.
Either party may bring an eligible claim in small claims court instead of arbitration if the claim qualifies and remains in small claims court.
You may not use the Services in violation of U.S. export controls, sanctions, or applicable trade restrictions. You represent that you are not located in, organized under the laws of, or ordinarily resident in any sanctioned jurisdiction and are not on any restricted party list.
HarperFlow will not be liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, labor disputes, internet or hosting failures, cyberattacks, vendor outages, API disruptions, government actions, war, terrorism, civil unrest, power failures, payment processor disruptions, or platform changes.
These Terms, together with the Privacy Policy and any applicable order form, plan terms, DPA, or written agreement, form the entire agreement between you and HarperFlow regarding the Services.
If any provision is unenforceable, the remaining provisions will remain in effect.
You may not assign these Terms without our prior written consent. HarperFlow may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
Our failure to enforce a provision is not a waiver.
Sections that by their nature should survive termination will survive, including ownership, licenses, payment obligations, disclaimers, limitation of liability, indemnification, arbitration, and governing law.
